Environmental, Social and Governance (ESG) considerations are no longer limited to voluntary frameworks or sustainability reports—they are increasingly embedded into hard law and shaping corporate behaviour across sectors. With the introduction of binding instruments like the Corporate Sustainability Reporting Directive (CSRD) and the Corporate Sustainability Due Diligence Directive (CS3D), companies face growing expectations around transparency, accountability, and human rights or environmental impacts throughout their value chains.

This evolving legal landscape is mirrored by a rise in litigation that goes beyond individual grievances and instead targets systemic issues—whether related to climate change, social justice, or governance failures. Disputes in this space are becoming more complex, more public, and often aim at regulatory or societal change. The topic touches on how organisations anticipate legal exposure, interpret emerging duties, and navigate a legal environment where ESG performance is increasingly subject to legal enforcement and challenge.
